      生态环境损害救济条款是环境法典不可或缺的一部分。于环境法典中统一规定生态环境损害救济相关内容既顺应生态环境损害救济工作一体化、综合性的特点，也是环境法典内容全面性的必然要求。环境法典中的生态环境损害救济条款应当在公私法路径协同的指引下，一方面发挥公法路径的主导作用，另一方面注重私法路径的辅助功能。生态环境责任编中的生态环境损害救济条款需处理好与总则编的关系，并且涵盖实体性规定、程序性规定和配套性规定。

      The articles for ecological environment damage relief are indispensable part of the environmental code. The unified provision of ecological environment damage relief in environmental code not only conforms to the integrated and comprehensive characteristics of the ecological environment damage relief work，but also is the inevitable requirement of the comprehensive content of environmental code. Under the guidance of the public-private law coordination path，the articles for ecological environment damage relief in the environmental code should play the leading role of the public law path on the one hand，and pay attention to the auxiliary function of the private law path on the other hand. The articles for ecological environment damage relief in the ecological environment liability series should deal with the relationship with the general part of environmental code，and cover substantive provisions，procedural provisions and supporting provisions.
