      经济转型的历史阶段，通过供给侧改革，鼓励创业创新，增强经济增长的内生动力，是中国经济增长政策的重点。法律制度能够通过重新分配市场资源、保护创新创业成果、提高市场参与者的履约水平，对创业创新行为起到推动作用。具有规范性、稳定性和可预测性等特征的法律制度能够更好地鼓励和促进创业与创新。创业创新行为的不确定性和成文法的滞后性，使得其在推动和规范创业创新行为上具有一定的矛盾关系。这种冲突可以通过加强商事审判队伍的专业性和提升商事判例的法律效力来解决。

英文摘要:

      Introducing supply-side reforms, encouraging innovation and entrepreneurship, and strengthening the endogenous motive force of economic growth is the key of China’s economic growth policy in the economic transitional period. The legal system can redistribute market resources, protect fruits of innovation and entrepreneurship, and improve the market participants’ ability to perform contracts, thus promoting innovation and entrepreneurship. The legal system, characterized with normalization, stability and predictability, is beneficial for encouraging and accelerating innovation and entrepreneurship. The uncertainty of innovation and entrepreneurship and hysteresis of statutory laws are inconsistent with the promotion and normalization of innovation and entrepreneurship. The contradictions can be solved by strengthening professional quality of the commercial adjudication personnel and the legal validity of the commercial cases. The paper analyzes the current legal status in China and its shortcomings, and then proposes some suggestions.
