      就低争议额电子商务交易，司法解决争议的经济和时间成本过于高昂，其争议解决的供给不能依靠司法。公共理性要求提供替代司法的机制实现这类电子商务争议的公平有效解决，为此，需要构建电子商务交易中立网上争议解决机制，这一机制需具有权威性、中立性和非营利性，无法由市场自动生成，需要政府提供。依托网上争议解决平台，组建专门的调解机构并整合现有的仲裁机构资源提供网上争议解决服务，设立自足的执行体系，这一机制可以满足回应性争议解决的需求，并有助于培养当事人理性解决争议的观念和自行解决争议的能力。

英文摘要:

      The dispute of low-value e-commerce transaction is not expected to be solved by law suits because of high expenses and time cost. The rational public expects such e-commerce disputes to be solved fairly and efficiently. Accordingly, it is necessary to establish a neutral online dispute solution system, which should be authoritative, neutral, and non-profitable and set up by government rather than the market itself. The establishment of the online dispute solution platform and specialized mediation institutions and reorganization of existing arbitral institutions can provide online dispute solution services and set up the self-sufficient enforcing mechanism. The above measures are expected to satisfy the requirements for the dispute solution, and are helpful to foster the parties’ capability of solving disputes rationally and independently.
