创新社会管理,提高社会管理科学化水平,是当前理论界和各级政府关注的热点问题之一。如何创新社会管理,从不同的视角可以有不同的认识和相应的措施。针对当前社会管理中的突出问题,创新社会管理的体制、机制、方法、手段,其落脚点是实现国家各项工作的法治化。因而,除了建立、健全各种社会管理机构和社会组织之外,创新社会管理,在各种方法和手段的运用中,法律手段是最基本的手段;创新社会管理的理念思路,法治思维是应当确立的基本思维模式。法治思维是一种国家治理的理念、视角和思路,重视运用法律规则和手段化解社会矛盾,使法治成为一种普遍的行为模式。法治缺失是导致社会矛盾凸现和激化的重要因素,法治思维是社会管理创新的必然要求,法律手段是创新社会管理的最基本手段,具体法治是创新社会管理的基本路径。 |

Innovating social management and improving the scientific level of social management have become the focus of the current theoretical circles and governments at all levels. There are different viewpoints and corresponding measures about social management innovation. In view of serious problems of current social management, the system, mechanism, method and measure of social management should be innovated, and the basic point is that the administration of national affairs should be legalized. Furthermore, besides establishing and perfecting various social management organizations and social institutions, in the process of innovating social management, legal measures are the basic one among all kinds of social management measures. The thought of rule by law should be established as the guideline of innovating social management, which is the idea, perspective and thought of state governance. Social problems should be solved based on law and rule by law should be regarded as a widespread behavior model. Deficiency of rule by law usually leads to serious social conflicts, therefore, the thought of rule by law is the inevitable requirement for social management innovation, the legal measure is the basic means of innovating social management, and the substantialization of rule by law is the basic guideline of innovating social management. |
